These Terms of Service govern your purchase, download, and use of SpeakType ("Software") and the website at app.fixthatflow.com ("Site"). By purchasing, downloading, installing, or using the Software, you agree to these terms. If you do not agree, do not purchase, install, or use the Software.
SpeakType is a Windows desktop tool that uses your own Groq API key to transcribe speech and paste text into any application. The Software is sold as a one-time purchase with no subscription or recurring fee.
The Software operates locally on your machine. Audio captured by your microphone is sent directly from your computer to Groq's servers using your own Groq API key. MTAAH does not receive, store, process, or transmit your audio data at any point.
Upon purchasing the Software, MTAAH grants you a personal, non-exclusive, non-transferable license to install and use the Software on computers you own or control, for personal or internal business purposes.

The Software is sold at a one-time price of $29.00 USD. There are no subscription fees, renewal fees, or recurring charges of any kind. Payment and delivery are handled by Polar.sh, which acts as Merchant of Record and is responsible for collecting and remitting applicable taxes.
You are entitled to a full refund within 30 days of purchase if you are not satisfied for any reason. To request a refund, email speaktype@fixthatflow.com. Refunds are processed within 1 business day of the request.
The Software requires a Groq API key that you obtain independently from Groq, Inc. (groq.com). Your use of Groq's services is governed solely by Groq's own terms of service and privacy policy. MTAAH has no control over Groq's availability, pricing, data practices, or any changes Groq makes to its services.
You are solely responsible for compliance with Groq's terms and for all API usage costs beyond Groq's free tier. MTAAH receives no portion of any fees you pay to Groq.
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MTAAH EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF RESULTS. MTAAH DOES NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS, OPERATE WITHOUT INTERRUPTION, OR BE FREE OF ERRORS OR DEFECTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MTAAH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR SYSTEM FAILURE, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
MTAAH'S TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SOFTWARE SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE SOFTWARE ($29.00 USD).
The Software is designed so that your audio never passes through MTAAH's infrastructure. However, no software can guarantee complete security on your device. Your computer's security is your own responsibility. MTAAH is not liable for unauthorized access to your system, data breaches, malware infections, or other security incidents on your computer, whether related to the Software or not.
Windows SmartScreen may display a warning when running the installer because the Software is independently published. This is expected behavior for all indie Windows software and does not indicate that the Software is malicious.
You agree to defend, indemnify, and hold harmless MTAAH from and against any claims, damages, costs, and expenses (including reasonable legal fees) arising from your use or misuse of the Software, your violation of these Terms, or your violation of any third-party rights including Groq's terms of service.
MTAAH may update these Terms at any time. Updated terms will be posted on this page with a revised "last updated" date. Continued use of the Software after a material change constitutes acceptance of the updated terms. Material changes will be announced via the support email for existing customers where reasonably practicable.
These Terms are governed by applicable law. Any disputes shall be resolved in the competent courts of the jurisdiction where MTAAH resides. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
